Supplier
Supplier of substance or preparation: means every producer, importer, further
user or distributor which introduces the substance to the market, either in its own form, or as a component of preparation, or as a preparation.
Product supplier: means producer or importer of a product, distributor or other participant of the supply chain which introduces the product to the market.
The Supplier is obliged to keep information about the chemicals in the form of a data sheet, when applicable. If there is no such application, according to the article 31 of the Order, the Supplier provides the Recipient with the following information:
- a) registration numbers, mentioned in article 20 act 3, if they are available, for each substance, for which the information is stored, according to item b), C), or d);
- b) information wether the substance requires authorization and details related to every granting, or refusal to grant, the authorization in this supply chain, according to the regulations of title VII of the Order;
- c) details concerning every case of applying the restriction according to the regulations of title VIII;
- d) any other available and appropriate information regarding the substance, necessary to allow to define and apply appropriate means of risk control, including the particular conditions resulting from applying section 3 of the annex XI.
The Suppliers update these information, without unnecessary delay, in the following situations:
- whenever new information appear which can have an influence on the means of risk control, or new information about threats;
- in the case of granting, or refusal to grant, the authorization;
- in the case of applying a limitation.
If the Supplier made an initial registration of a substance, he is obliged to provide the Recipient with the register number.
On the Recipient’s request, the Supplier is obliged to place the indicated application in the registration documents.
The Supplier of a product which contains, in concentration, over 0.1% of weight of a substance which meets the criteria comprised in article 57 and identified according to article 59 act 1, provides the Recipient with sufficient information, which he has at his disposal, and which allow to use the product in a safe manner, or at least the name of the substance.
